Fengshun County "Photovoltaic + Building" Pilot Program Guidelines (Trial Implementation)
Chapter 1 General Provisions

Article 1 In order to earnestly implement the specific deployment of the Provincial Party Committee's "1310" plan, deeply implement the "High-Quality Development Project for Hundreds of Counties, Thousands of Towns, and Ten Thousand Villages," effectively implement the "Guangdong Provincial Pilot Program for Promoting County-Level "Photovoltaic + Building" Applications" (Yue Jian Ke [2024] No. 200), promote the improvement of urban and rural building styles, and promote the high-quality development of distributed photovoltaics in counties, this guideline is formulated in accordance with relevant policy documents and standards such as the "People's Republic of China Urban and Rural Planning Law" and the "Guangdong Provincial Guidelines for County-Level "Photovoltaic + Building" Application Pilot Program (First Edition)" (Yue Jian Ke [2024] No. 256).

Article 2 "Photovoltaic + Building" refers to distributed photovoltaic power generation projects constructed and installed on buildings (structures). Distributed photovoltaic power generation projects refer to photovoltaic power generation facilities built on the roofs of buildings that have the characteristics of balancing and adjusting the power grid system. Distributed photovoltaic power generation projects are divided into "Photovoltaic + Building" projects for natural persons and "Photovoltaic + Building" projects for non-natural persons.

A "Photovoltaic + Building" project for natural persons refers to a distributed photovoltaic power generation project invested and constructed by a natural person using their own buildings (structures), with a public connection point voltage level not exceeding 380 volts.

A "Photovoltaic + Building" project for non-natural persons refers to "Photovoltaic + Building" projects other than distributed photovoltaic power generation projects for natural persons, such as photovoltaic power generation projects applied for and constructed by industrial and commercial enterprises using the roofs of their factory buildings or leasing the roofs of other owners in the name of the enterprise.

Article 3 "Photovoltaic + Building" projects adopt an operation model of "self-generation and self-use, surplus power grid connection, nearby consumption, full grid connection, and grid regulation".

Article 4 "Photovoltaic + Building" projects should verify the existence of illegal land use or illegal construction before application and filing. Buildings without legal land sources or property certificates should be verified by the local government to ensure that the buildings for which photovoltaics are planned to be built comply with legal regulations, and the construction of photovoltaics should not result in illegal land use.

For existing buildings implementing "Photovoltaic + Building" applications, factors such as the structural safety of the original building, roof structure, and years of use should be comprehensively considered. Inspections and assessments should be conducted on the building in the early stages of the project, and if necessary, a qualified unit should be commissioned to conduct a structural reliability assessment.

Chapter 2 Application and Filing

Article 5 For "Photovoltaic + Building" projects for natural persons, applicants should truthfully fill out the "Fengshun County "Photovoltaic + Building" Project Application Form" and provide materials such as the "Real Estate Ownership Certificate" (for buildings where property certificates cannot be obtained due to historical reasons, the town and above government departments confirm that they do not involve illegal land use and have the authority to prove property rights), photovoltaic design drawings, renderings, and letters of commitment to the town government for application. After review and approval by the relevant county departments, the county power supply department will collectively file them with the county Development and Reform Bureau.

The following materials need to be submitted for project application:

(1) Fengshun County "Photovoltaic + Building" Project Application Form;

(2) Copy of applicant's ID card;

(3) Real estate ownership certificate and other property ownership certificates;

(4) Design plan, renderings;

(5) Letter of commitment.

Article 6 For "Photovoltaic + Building" projects for non-natural persons, applicants should truthfully fill out the "Fengshun County "Photovoltaic + Building" Project Application Form" and provide materials such as the "Real Estate Ownership Certificate" (for buildings where property certificates cannot be obtained due to historical reasons, the town and above government departments confirm that they do not involve illegal land use and have the authority to prove property rights), photovoltaic design drawings, renderings, and letters of commitment to the town government for application. After review and approval by the relevant county departments, they should log in to the "Guangdong Provincial Investment Project Online Approval and Supervision Platform" to file according to the prescribed procedures.

The following materials need to be submitted for project application:

(1) Fengshun County "Photovoltaic + Building" Project Application Form;

(2) Copy of the enterprise's business license or organization code certificate with the enterprise's official seal;

(3) Copy of the legal representative's ID card;

(4) Copy of the operator's ID card;

(5) Proof of no illegal land use;

(6) Design plan, renderings;

(7) Letter of commitment.

Article 7 The power supply department should strengthen grid capacity management, strengthen grid transformation planning and construction, provide system support for the operation of "Photovoltaic + Building" projects, and ensure the safe use of electricity by power users.

Chapter 3 Construction Requirements

Article 8 The buildings on which "Photovoltaic + Building" projects are based should be legal, with clear property rights or complete and undisputed property lease procedures. Owners of houses should be vigilant and prevent third parties from using deceptive means to handle illegal photovoltaic loans, causing unnecessary losses.

Article 9 The design style of the "Photovoltaic + Building" project must meet the requirements of appearance control and must not be arbitrarily constructed. Each town people's government should guide applicants in formulating project design plans in accordance with the "Fengshun County "Photovoltaic + Building" Appearance Control Guidelines" and effectively strengthen the appearance control of photovoltaic construction.

(1) For existing rural house buildings, "Photovoltaic + Building" projects should preferably adopt a sloped roof form. When existing buildings have sloped roofs, they should be installed along the slope, and the components should not exceed the highest point of the installed roof. The surface of the component array should be as close as possible to the installed roof. When existing buildings have flat roofs, the slope of the roof photovoltaic components in key areas for appearance control should generally be no less than 10 degrees. Considering the needs of drying and water tank placement, some open spaces should be set up.

(2) The added height of the photovoltaic power generation system for rural houses should not exceed 2.8 meters from the highest point of the roof. When there is a stairwell on the roof and photovoltaic components need to be installed on the roof of the stairwell, the highest point should not be higher than 1.0 meter above the roof of the stairwell. The photovoltaic components on the stairwell and the roof should be designed in different levels and layers to avoid the roof being too large and out of harmony with the architectural style.

(3) Photovoltaic power generation systems should adopt different landscape coordination measures based on the installation height. They can be concealed using parapets, with parapets handled according to building codes, or installed using a setback method to avoid affecting the building facade's appearance. When photovoltaic components protrude from the roof, distinguish between the control points for key areas and general areas. Adapting to local conditions, combining traditional Lingnan architectural design elements, using double-slope or four-slope roofs, and selecting photovoltaic support components and photovoltaic system frames that coordinate with the building's color, local architectural cultural elements can be incorporated using grid components, eave designs, etc., to transform and upgrade the building's exterior, forming a relatively complete architectural image.

(4) Specific height limits for photovoltaic systems in industrial and public buildings can be determined based on actual conditions.

Article 10 It is prohibited to increase illegal photovoltaic construction land under the pretext of constructing "Photovoltaic + Building" projects.

The following situations are not suitable for implementing "Photovoltaic + Building" projects:

1. The building(s) on which the project is based do not have legal compliance.

2. Buildings identified as Class C or D dangerous buildings and old houses with safety hazards;

3. Buildings classified as Class A or B fire hazards;

4. Buildings included in the demolition plan:

5. Ancient buildings;

6. Buildings within the core protection area and construction control zone of scenic spots, historical and cultural protection areas (famous towns and villages), historical and cultural streets, the core protection area of historical buildings, traditional villages, the heritage area and buffer zone of world heritage sites, the protection area and construction control zone of cultural relics protection units, whose installation would negatively impact the overall appearance:

7. Other buildings that relevant competent authorities require should not be fitted with photovoltaic systems.

Article 11 During construction, the project construction unit is the responsible entity and bears the primary responsibility for safety production; after the project is connected to the grid and transferred, the project owner or the entrusted operating unit is the responsible entity for the project's safety production.

Article 12 "Photovoltaic + Building" project-related participating units should be legally registered enterprises without serious bad credit or illegal records; project design, construction, supervision, testing, and operation and maintenance management responsible units should have the corresponding qualifications; professional and technical personnel engaged in the design, construction, supervision, testing, and operation and maintenance of "Photovoltaic + Building" projects should obtain the corresponding professional qualifications.

Article 13 "Photovoltaic + Building" projects should be implemented strictly in accordance with energy engineering, construction project quality and safety requirements, standards, and relevant management regulations.

All participating units should strictly fulfill their responsibilities for the quality and safety management of "Photovoltaic + Building" projects. All participating units should establish a full-staff safety production responsibility system and safety production regulations, establish and improve a dual-prevention mechanism for the graded control of construction safety risks and the investigation and governance of hidden dangers, establish clear, public, and standardized work service processes and procedures, improve risk prevention and resolution mechanisms, strengthen safety production management, and ensure safety production.

For existing buildings implementing "Photovoltaic + Building" applications, the structural safety of the original building, roof structure, and years of use should be comprehensively considered. The building should be inspected and evaluated in the early stages of the project, and if necessary, a qualified unit should be commissioned to conduct a structural reliability assessment.

"Photovoltaic + Building" projects must ensure that photovoltaic power generation does not affect the original production and living functions of the building and does not pose safety hazards to personnel, production, or materials.

Relevant functional departments shall, in accordance with their responsibilities, conduct dynamic management of the entire process of "Photovoltaic + Building" projects, including landscape control, architectural design, construction quality and safety, project acceptance, and record keeping.

Chapter 4 Project Acceptance

Article 14 "Photovoltaic + Building" projects should follow the project acceptance procedures, and the acceptance should be carried out by the local government and the power supply department.

Article 15 During the acceptance process, in addition to the normal business checks, the local government and the power supply department should also focus on the following matters:

1. Verify whether the installed capacity of the project is consistent with the design scheme submitted in the "Fengshun County "Photovoltaic + Building" Project Application Form";

2. Verify whether the photovoltaic components, inverters, and other equipment materials meet the specifications and design requirements;

3. Verify whether the project's anti-backfeeding test and lightning protection grounding device meet the specification requirements.

4. Whether the architectural landscape effect of the "Photovoltaic + Building" project meets the requirements of the "Fengshun County "Photovoltaic + Building" Landscape Control Guidelines", and whether it coordinates with the surrounding buildings and humanistic landscape.

Article 16 During project acceptance, the "Distributed Photovoltaic Power Generation Project Grid Connection Acceptance Opinion Form" should be truthfully filled out, and the acceptance personnel and photovoltaic owners should sign and confirm separately and affix the official seal of the acceptance unit. After passing the acceptance, the power supply department can handle the grid connection according to the procedure.

Article 17 Projects that do not follow the design, construction, and construction of this guideline, that are privately built, that provide false information, or that use counterfeit or substandard products will not pass the acceptance. The local government and the power supply department will respectively point out the existing problems and rectification measures and order the project owner to make rectifications. The power supply department can only handle grid connection according to the procedure after passing the acceptance. For projects that cannot be rectified and pass the acceptance, the power supply department shall not connect to the grid, and the resulting consequences shall be borne by the investor owner.

Chapter 5 Operation and Maintenance

Article 18 During the construction of photovoltaic projects, the construction enterprise is the responsible entity and bears the primary responsibility for safety production. Distributed photovoltaic project construction enterprises are encouraged to purchase third-party liability insurance for the photovoltaic projects they construct (due to accidents or natural disasters causing death or injury to third parties). After the project meets the requirements of this guideline, is connected to the grid, and the transfer is completed, the project owner or holder is the responsible entity for the project's safety production. Photovoltaic cleaning and maintenance (including the construction of fixed safety measures) should be uniformly handled by professional operation and management companies. The local government should conduct regular spot checks and inspections to effectively supervise and implement the safety production of the owners and construction units of photovoltaic projects under construction.

Article 19 Photovoltaic project construction and construction enterprises must establish a safety production responsibility system and establish a sound system for investigating and rectifying construction safety hazards. During the project construction process, the project manager must fill out the hazard investigation and inspection form to ensure the safety of project construction. The project construction unit shall conduct an inspection and record of the safe operation of the completed project every six months for five consecutive years. In case of special circumstances (before and after natural disasters such as typhoons and tornadoes, and situations such as component aging, damage, and instability), inspections and maintenance should be carried out and recorded in a timely manner.

Article 20 Photovoltaic project construction enterprises shall inspect completed photovoltaic projects in accordance with the requirements of this guideline, and projects that do not meet the requirements of this guideline must be rectified. Photovoltaic investment, construction, and operation enterprises that violate the provisions of this guideline shall be dealt with in accordance with relevant laws and regulations. Those suspected of crimes shall be transferred to judicial organs for investigation of criminal responsibility in accordance with the law. The dismantling and disposal of photovoltaic panels after their service life expires shall be handled by the construction unit or a qualified enterprise. If the construction unit goes bankrupt, is cancelled, or refuses to perform demolition and recycling, the demolition and disposal can be carried out by the local town and street.

Article 21 Encourage owners of "photovoltaic + building" projects to insure photovoltaic power stations.

Chapter 6 Supplementary Provisions

Article 22 Relevant departments of the county and the people's governments of various towns shall perform their duties to do a good job in the management of "photovoltaic + building" projects.

Article 23 This guideline shall be implemented from the date of its issuance. If there are other provisions by the state, province, or city, those provisions shall prevail.
